(WEST HENDON REGENERATION AREA) COMPULSORY PURCHASE ORDER (NO.3)2018 GENERAL VESTING DECLARATION NO.2 NOTICE SPECIFYING LAND AND STATING EFFECT OF GENERAL VESTING DECLARATION
NOTICE IS HEREBYGIVEN that the London Borough of Barnet ("the Authority")onThursday 2ndJuly 2020 executed aGeneral Vesting Declaration under section 4ofthe Compulsory Purchase (Vesting Declarations) Act 1981('theAct') vestingthe land described in the Schedule to this notice ("the Land") in themselves as from the end of the period of four months from the date on which service of the notices required by section 6ofthe Act is completed. The effect of the General Vesting Declaration is as follows: On the first day after the end of the period referred to in the first paragraph of this notice ("the Vesting Date") the Land, together with the right to enter upon andtake possession of it,willvest in the Authority. Also, on the Vesting Date the Acts providingfor compensation will apply as if,onthe date on which the General Vesting Declaration was made (namely,2nd July 2020) anoticetotreat had been served on every person on whom, under section 5ofthe Compulsory Purchase Act 1965, the Authority could have served such anotice(other than any person entitledtoa"minor tenancy" or a"long tenancy which is about to expire"). If the Land includes any landinwhich there is aminor tenancy or along tenancy which is about to expire, the right of entry will not be exercisable in respect of that land unless, after serving anotice to treat in respect of that tenancy, the Authorityhaving served on every occupier of any of the land in whichthe tenancy subsists anotice stating that, at the endof aspecified period (at least 3monthsfromthe date of the service of the notice) they intend to enter upon and takepossession of the land specified in the notice, and that period has expired: the vesting of the land willthen be subject to the tenancy until that period expires, or in the absenceofsuch notice to treat, the tenancycomes to an end [by exercise of Landlord and Tenant powers], whichever happensfirst. ScheduleA(Part 1) and Schedule Itothe Act contain supplementary provisions as to general vesting declarations. If acounter-notice is served under paragraph 2ofSchedule A(Part 1) within the period referred to in the first paragraph of this notice, the vesting date for the land which is the subject of the counter-noticewillbedetermined in accordance with that Schedule.
