NOTICE IS HERBY GIVEN by the London Borough of Barnet of 2 Bristol Avenue London NW9 4EW ("the Council')
Intention to Demolish
The Council intends to demolish the dwellings contained within Phase 1 (North) of the Whitefield Estate, Barnet listed below ("the Relevant Properties"). The reason for the intended demolition is to enable the first phase of the comprehensive regeneration of Brent Cross Cricklewood to go ahead. This includes the building of new homes, a new town centre, major new and improved transport and community facilities, and other infrastructure and enhanced public areas as part of a phased redevelopment.
Operation and Expiry of the Final Demolition Notice
The period within which the Council intends to carry out the proposed demolition is on or before the 11 November 2022. The Council shall serve the Final Demolition Notice on the Relevant Properties on the 12 November 2020 ("the Operative Date"). The Notices will cease to be in force on 11th November 2022 unless the Secretary of State extends the period for which this Notice is in force or it is revoked under the Housing Act 1985 Schedule 5 Paragraph 15. Condition
The following condition is satisfied in relation to this Notice:
The proposed demolition of the Relevant Properties does form part of a scheme involving the demolition of other premises, and one or more of those premises need to be acquired by us in order for the Council to be able to demolish them, and in each case arrangements for their acquisition are in place.
Effect of the Notice
The effect of this Final Demolition Notice whilst the Notice is in force is that the right to buy does not arise in respect of any dwelling referred to or forming part of the Relevant Properties and the Council will be under no obligation to make such a grant as is mentioned in section 138(1) of the Housing Act 1985 in respect of any claim to exercise the Right to Buy. Any existing claim to exercise the right to buy in respect of any dwelling referred to or forming part of the Relevant Properties will cease to be effective on the Operative Date.
Right to Compensation
Where this Notice has been served on a tenant who has an existing Right to Buy claim at the date of service of this Notice, Section 138C of the Housing Act 1985 gives the tenant a right to compensation in respect of certain expenditure incurred in relation to any existing Right to Buy claim.
